Terms & Conditions
These Terms & Conditions (“Terms”) govern access to and use of the Travel Design Plus platform, website and related services.
By accessing or using Travel Design Plus (“TDP”), the Client agrees to these Terms together with any applicable commercial agreement entered into with TravelDesignPlus BV.
1. Definitions
TDP refers to the software platform developed and operated by TravelDesignPlus BV.
Client refers to the travel agency, tour operator, DMC or other business entity that enters into an agreement to use TDP.
User refers to any individual authorized by the Client to access and use the platform.
Services refers to the functionality, software and related services provided through TDP.
2. Access and Use
TDP is provided for legitimate business use.
Clients are responsible for ensuring that access credentials are kept confidential and that authorized Users use the platform appropriately.
TDP may temporarily restrict or suspend access where there is reasonable evidence of misuse, a security risk, non-payment or a material breach of these Terms or the applicable commercial agreement.
3. Intellectual Property
TDP, including its software, source code, interface, design, branding, documentation and proprietary functionality, is owned by TravelDesignPlus BV or its licensors.
Clients receive a limited, non-exclusive and non-transferable right to use the platform for the duration of their agreement with TravelDesignPlus BV.
Nothing in these Terms transfers ownership of TDP or its intellectual property to the Client.
4. Client Content and Data
Clients remain responsible for the information, content and data they enter into TDP.
The Client must ensure that it has the appropriate rights and legal basis to process any customer, traveler, supplier or other personal information uploaded to the platform.
TravelDesignPlus BV processes data in accordance with applicable data-protection legislation and its published data-protection policies.
5. Privacy and Data Protection
TDP processes personal data in accordance with applicable European data-protection requirements, including the GDPR where applicable.

6. Service Availability
TravelDesignPlus BV aims to provide reliable and continuous access to TDP.
However, uninterrupted or error-free availability cannot be guaranteed.
Scheduled maintenance, platform updates or unforeseen technical issues may occasionally affect availability. Where reasonably possible, Clients will be informed in advance of planned disruptions.
7. Third-Party Services
TDP may connect with or rely on third-party services, infrastructure or integrations.
TravelDesignPlus BV is not responsible for interruptions, changes or failures caused solely by independent third-party providers outside its reasonable control.
8. Limitation of Liability
To the extent permitted by applicable law, TravelDesignPlus BV shall not be liable for indirect, incidental, special or consequential losses resulting from the use or inability to use TDP.
Unless otherwise agreed in writing, TravelDesignPlus BV's aggregate liability shall not exceed the fees paid by the Client during the twelve months preceding the event giving rise to the claim.
9. Changes to the Platform
TDP is continuously developed and improved.
TravelDesignPlus BV may introduce updates, improvements or changes to functionality where these changes do not materially undermine the core service purchased by the Client.
10. Changes to These Terms
These Terms may be updated from time to time to reflect changes to the platform, applicable law or business operations.
Material changes will be communicated through appropriate channels such as email or platform notification.
11. Termination
Termination of the Client's subscription or commercial agreement is governed by the applicable agreement between the Client and TravelDesignPlus BV.
Following termination, Client data may remain available for a limited period before being securely deleted in accordance with TDP's data-retention procedures. The current public page states a 90-day retention period.
12. Governing Law and Jurisdiction
These Terms and any agreement relating to TDP are governed by the laws of the Netherlands. Any dispute shall be submitted to the competent courts in the Netherlands, unless mandatory law provides otherwise.
